Welcome to FSBOTN.com. These Terms of Service (“Terms”) govern your access to and use of the website located at https://fsbotn.com (the “Site”) and all related services provided by FSBOTN.com (“we,” “us,” or “our”). By accessing or using the Site, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account, listing a property, or otherwise using our Site, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use our Site.

2. Eligibility

You must be at least 18 years of age and legally capable of entering into binding contracts to use our Site.

3. Account Registration

To access certain features, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Keep your password secure and confidential
  • Accept responsibility for all activities that occur under your account
  • Notify us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Property Listings

4.1 Listing Requirements

When listing a property on FSBOTN.com, you represent and warrant that:

  • You are the legal owner of the property or authorized to list it for sale
  • All information provided is accurate, truthful, and not misleading
  • All photos are of the actual property and you have the right to use them
  • The property is located in the state of Tennessee
  • The listing complies with all applicable local, state, and federal laws

4.2 Listing Fees and Duration

Listing fees are non-refundable once your listing has been published. Listings remain active for the duration specified at the time of purchase (currently 180 days). Optional upgrades are also non-refundable once activated.

4.3 Content Ownership

You retain ownership of the content you submit. By submitting content, you grant FSBOTN.com a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute your content in connection with operating and promoting the Site.

5. Payments

All payments are processed through Stripe, a third-party payment processor. We do not store your credit card information on our servers. All prices are in U.S. dollars.

6. Prohibited Conduct

You agree not to:

  • Use the Site for any unlawful purpose
  • Post false, misleading, or fraudulent listings
  • Impersonate any person or entity
  • Interfere with or disrupt the Site
  • Scrape, crawl, or use automated means to access the Site without permission
  • Transmit viruses, malware, or other harmful code
  • Harass, threaten, or intimidate other users
  • Use the Site to send unsolicited communications

7. Disclaimer of Warranties

THE SITE AND ALL SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FSBOTN.COM SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. Our total liability shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

9. Indemnification

You agree to indemnify, defend, and hold harmless FSBOTN.com from and against any claims arising out of your use of the Site or violation of these Terms.

10. FSBOTN.com is Not a Real Estate Broker

FSBOTN.com is a platform that enables homeowners to list their properties for sale by owner. We are not a licensed real estate broker, agent, or advisor.

11. Intellectual Property

The Site and its original content, features, and functionality are owned by FSBOTN.com and are protected by copyright, trademark, and other intellectual property laws.

12. Termination

We may terminate or suspend your account at our sole discretion for conduct that violates these Terms.

13. Governing Law

These Terms shall be governed by the laws of the State of Tennessee. Any disputes shall be resolved in the courts located in Tennessee.

14. Changes to Terms

We reserve the right to modify these Terms at any time. Your continued use of the Site after changes constitutes acceptance.

15. Severability

If any provision of these Terms is found to be unenforceable, that provision will be limited or eliminated to the minimum extent necessary.
